Please read these Terms of Service (“Terms”) carefully before using BayAreaWeddings.com. By accessing or using the Site, you agree to be bound by these Terms.
1. About the Site
BayAreaWeddings.com is an online wedding vendor directory serving the San Francisco Bay Area. The Site connects couples planning weddings (“Users”) with local wedding service providers (“Vendors”). We do not provide wedding services directly; we facilitate connections between Users and Vendors. The Site is free to browse and no account is required to search the directory or contact vendors.
2. Eligibility
You must be at least 18 years of age to use the Site. By using the Site, you represent that you are 18 years of age or older.
3. Vendor Listings
Accuracy and no endorsement
Vendor listings are provided for informational purposes. We list vendors based on publicly available information. We do not verify, endorse, or guarantee the quality, accuracy, safety, or legality of any vendor or their services. You are solely responsible for evaluating vendors before engaging their services. Couples should conduct their own due diligence.
Featured and sponsored listings
Some vendor listings may appear as "Featured" or "Sponsored." These listings have paid for priority placement. Featured or sponsored placement does not constitute an endorsement of the vendor's services, quality, or reliability. All material connections between BayAreaWeddings.com and featured vendors are disclosed in accordance with FTC guidelines.
Listing claims
Vendors may claim their listing by providing their business contact information through the claim form. We reserve the right to verify claimed listings and to remove listings that violate these Terms or contain inaccurate information.
Listing updates
Vendors who have claimed their listing may request updates to their profile information by contacting us. We reserve the right to approve or reject any requested changes.
4. User Conduct
You agree not to:
- Submit false, misleading, or fraudulent information through any form on the Site
- Submit spam, malicious code, or automated requests
- Attempt to gain unauthorized access to any part of the Site or its infrastructure
- Use the Site to harvest contact information for commercial purposes without our consent
- Interfere with the operation of the Site or its servers
- Use the Site in any manner that violates applicable federal, state, or local law
- Impersonate any person or entity or falsely represent your affiliation with any vendor
5. Inquiry Submissions
When you submit an inquiry through the Site, you consent to us sharing your contact information (name, email, phone) with the vendor(s) relevant to your inquiry. We are not responsible for how vendors use your contact information once shared. We recommend reviewing each vendor’s privacy policy before engaging with them directly. Inquiry submissions are subject to our rate limits to prevent abuse.
6. Guest Posts and User-Submitted Content
By submitting content (blog posts, articles, or other materials) to the Site, you grant us a non-exclusive, royalty-free, perpetual license to publish, modify, and distribute that content in connection with the Site. You represent that you own or have the right to submit such content and that it does not infringe any third party’s intellectual property rights, privacy rights, or any applicable law.
We reserve the right to reject, edit, or remove any submitted content at our sole discretion, including content that is false, defamatory, offensive, contains spam links, or otherwise violates these Terms. All guest post submissions are subject to editorial review before publication.
7. Intellectual Property
All content on the Site (excluding user-submitted content and vendor-provided content) is owned by or licensed to BayAreaWeddings.com and is protected by copyright and other intellectual property laws. This includes site design, text, graphics, logos, and software. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
Vendor-provided content (photos, business descriptions, logos) remains the property of the respective vendor. By submitting content to us, vendors grant BayAreaWeddings.com a non-exclusive license to display that content on the Site in connection with their listing.
8. Disclaimer of Warranties
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT ENDORSE ANY VENDOR LISTED ON THE SITE AND MAKE NO REPRESENTATIONS ABOUT THE QUALITY OR SUITABILITY OF ANY VENDOR’S SERVICES.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAYAREAWEDDINGS.COM AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, RELIANCE ON ANY VENDOR LISTED ON THE SITE, OR ANY VENDOR’S SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless BayAreaWeddings.com and its owners, operators, employees, and affiliates from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third party’s rights; or (d) any content you submit to the Site.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in California. You consent to the personal jurisdiction of such courts.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
